These Terms of Service govern use of the Etqan website and, together with your proposal, quotation, or service agreement, the GPS tracking products and services we supply in the UAE.
Agreement
By using this website, requesting a demo, or using Etqan hardware, software, or support, you agree to these terms. If you are acting for a company, you confirm you are authorised to bind that company.
If a signed service agreement conflicts with these website terms, the signed agreement controls for that paid service.
Our services
Etqan supplies GPS devices, professional installation (where ordered), platform access, and related monitoring modules such as fuel, temperature, driver behaviour, assets, tyres, and cold chain — as described in your order.
Live tracking depends on GPS, mobile networks, vehicle power, correct installation, and correct use. Coverage and update rates can vary by location, environment, and hardware.
Customer responsibilities
You are responsible for:
- Providing accurate vehicle, site, and contact information.
- Using the platform only for lawful fleet, asset, and business purposes.
- Keeping login credentials secure and limiting access to authorised staff.
- Informing drivers or staff about monitoring where your policies or the law require it.
- Maintaining vehicles and power so devices can operate as designed.
Acceptable use
You must not misuse the website or platform, including attempting unauthorised access, interfering with other customers, reverse engineering our software except as allowed by law, or using tracking data for unlawful surveillance or harassment.
Hardware and installation
Hardware remains subject to the warranty and replacement terms in your order. Tampering, incorrect third-party fitting, or unauthorised removal can affect performance and warranty.
Installation appointments depend on vehicle access and site conditions. Delays caused by inaccessible vehicles are not Etqan’s responsibility.
Fees and payment
Subscription, hardware, and installation fees are as quoted. Unpaid accounts may be suspended. Prices may change for renewal periods with notice, unless a contract says otherwise.
Intellectual property
The Etqan name, logo, website content, and software remain our property or that of our licensors. You receive a limited, non-exclusive right to use the platform for your internal operations during an active paid term.
Limitation of liability
Tracking is an operational aid. It does not replace driver duty of care, insurance, or physical security. To the extent permitted by UAE law, Etqan is not liable for indirect, incidental, or consequential loss, or for loss arising from network outages, GPS inaccuracy, customer misuse, or force majeure.
Nothing in these terms excludes liability that cannot legally be excluded, including for fraud or death or personal injury caused by negligence where such exclusion is not allowed.
Suspension and termination
We may suspend access for non-payment, security risk, or material breach. After termination, platform access ends and remaining hardware terms follow your contract.
Governing law
These terms are governed by the laws of the United Arab Emirates. Courts of the Emirate of Sharjah (or as stated in your signed agreement) have jurisdiction, without limiting any mandatory consumer protections that apply.
